Terms of Service

1. Purpose

These Terms of Service (“Terms”) outline the terms under which you (“User”) may access and use the Mima application (“App”) provided by Mima Health ("Mima"), ZA COURTABOEUF, 7 AVENUE DE LAPONIE, 91940 LES ULIS, France. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. Services

Mima provides users with the ability to track, analyze, and manage their health data, focusing primarily on activities, wellbeing and symptoms recording through text or voice interaction. Mima leverages AI technology, including Large Language Models (LLMs), to assist in extracting and analyzing user-reported symptoms, and reporting them back to the user.

3. Data Collection and Use

To be able to use Mima, you need to provide consent to the collection of personal information that you share during your interactions with the App. The types of data collected and the purpose of the data processing are outlined in our Data Privacy Policy.

4. AI Disclaimer

Mima incorporates AI-driven models to analyze and provide suggestions based on the symptoms you report. You agree the following:

• AI Limitations: The AI models used by Mima are not medical professionals, and the information they provide should not be interpreted as medical advice.
• Medical Disclaimer: The App is not a medical device, and does not provide medical advice. It is not intended to replace professional medical consultations. Always consult your healthcare provider for any medical concerns.
• No Responsibility for AI Outcomes: Mima is not liable for any potential misinterpretation or misuse of the information provided by the App's AI-based models.

5. User Responsibilities and acceptable use

Users are responsible for:

• Providing accurate and up-to-date information while interacting with the App.
• Consulting a qualified medical professional regarding any medical concerns.
• Keeping login credentials secure and immediately notifying the Mima Health team at support@askmima.com of any unauthorized access to your account.

Users must not:

• Use the App or service for any unlawful purposes.
• Reverse engineer, decompile, or attempt to derive the source code of the App.
• Share their account or login credentials with any third party.
• Harass or harm others;
• Attempt to breach or test the App’s security;
• Upload harmful code or content;
• Interfere with service availability.

6. Account Management

To use the App, you must create an account. You agree to provide accurate information during registration and keep your information updated. You are responsible for all activities that occur under your account, and you must promptly notify Mima of any unauthorized use or suspected security breach.

7. Limited License

Mima grants you a non-transferable, non-exclusive, revocable, and limited license to install and use the App, solely for your personal, non-commercial purposes and in accordance with these Terms. You do not own any rights to the App, including its design, code, and proprietary algorithms, except for the limited use rights granted here.

8. Intellectual Property

All rights, title, and interest in the App and its content, including text, images, code, and trademarks, belong to Mima or its licensors. No part of the App may be reproduced, copied, or distributed without explicit written permission from Mima.

9. Limitation of Liability

Mima provides the App “as is” without any warranties or guarantees of any kind. To the maximum extent permitted by law:

• No Guarantee of Accuracy: Mima does not guarantee the accuracy or completeness of the App's outputs.
• Limitation of Damages: Mima is not liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to data loss, health outcomes, or any financial losses arising from the use or inability to use the App.
• AI and Health Outcomes: Mima is not responsible for any health-related outcomes that may arise from relying on the information provided by the App's AI systems.

10. Termination

Mima reserves the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including a breach of these Terms. Upon termination, your right to use the App will cease immediately, and you must uninstall and delete all copies of the App from your devices.

11. Changes to the Terms

Mima may modify these Terms at any time. In the event of material changes, we will notify you either through the App or via email. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts in Paris, France.
